1. Acceptance of Terms

By accessing or using VoyaBear at voyabear.com ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service

VoyaBear is an AI-powered travel personality and planning platform. The Service includes:

• Travel Personality Quiz — A quiz that determines your bear travel personality type (e.g., Balanced Bear, Adventure Bear, Culture Bear) based on your travel preferences
• Personalized Recommendations — AI-curated destination and attraction suggestions matched to your personality
• AI Itinerary Builder — Generate day-by-day trip itineraries powered by AI
• Bucket List — Save destinations you want to visit and track places you have visited
• My Trips — Organize, plan, and share trip itineraries with collaborators
• Explore — Browse destinations, attractions, and activities globally
• Bear Avatar Collection — Unlock and collect bear avatars by completing quests, achievements, and reaching milestones
• Gamification — Earn XP, level up, complete daily quests, maintain login streaks, and unlock achievements
• Journey Companion — An AI travel assistant for trip advice and recommendations

3. User Accounts

3.1 Account Creation

You must create an account to access most features. You may sign up with an email and password or via Google OAuth. You agree to:

• Provide accurate and complete information during registration
• Keep your password secure and confidential
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized access to your account

3.2 Age Requirement

You must be at least 13 years old to use VoyaBear. Users under 18 should have parental or guardian consent before using the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate any person, entity, or VoyaBear staff
• Attempt to gain unauthorized access to the Service, database, or other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools, bots, or scrapers to access the Service
• Exploit the gamification system (XP, quests, achievements) through automated or fraudulent means
• Upload malicious code, viruses, or harmful content
• Harass, threaten, or harm other users

5. AI-Generated Content

5.1 Accuracy Disclaimer

VoyaBear uses AI to generate travel itineraries, recommendations, and responses from the Journey Companion. AI-generated content may contain errors, outdated information, or inaccuracies. You should:

• Verify all travel information (visas, entry requirements, safety advisories) through official sources
• Confirm booking details, prices, and availability directly with providers
• Treat AI recommendations as suggestions, not professional travel advice

5.2 No Liability for AI Output

VoyaBear is not responsible for any loss, damage, or inconvenience resulting from following AI-generated recommendations, including financial losses, travel disruptions, or missed bookings.

6. Gamification & Virtual Items

VoyaBear includes a gamification system with XP, levels, achievements, daily quests, and a bear avatar collection. Please note:

• XP, levels, achievements, and bear avatars have no monetary value and cannot be transferred or redeemed
• We reserve the right to modify, reset, or remove gamification rewards at any time
• Accounts found exploiting the quest or achievement system may be suspended
• Avatar unlocks are tied to your account and are not transferable

7. Trip Sharing & Collaboration

VoyaBear allows you to share trips with other users. When sharing a trip:

• You are responsible for the content of trips you share
• Collaborators you invite may view and edit the shared itinerary
• You may revoke access to a shared trip at any time from your Trip settings
• Do not share trips containing private or sensitive personal information

8. Third-Party Services

The Service integrates with third-party providers including Google Maps, Viator, Unsplash, and OpenAI. Your use of features powered by these services is subject to their respective terms. VoyaBear is not responsible for third-party service outages, inaccuracies, or changes in API availability.

9. Intellectual Property

9.1 Our Content

All content, design, branding, bear characters, avatars, logos, and software are owned by or licensed to VoyaBear and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without prior written consent.

9.2 Your Content

You retain ownership of content you create within the Service (trip notes, ratings, itineraries). By using the Service, you grant VoyaBear a limited, non-exclusive license to store and display your content solely to provide the Service to you.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

VoyaBear does not warrant that the Service will be:

• Uninterrupted, error-free, or free from bugs
• Accurate or complete in AI-generated recommendations
• Free from viruses or other harmful components

11. Limitation of Liability

To the maximum extent permitted by law, VoyaBear shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to travel disruptions, booking errors, data loss, or reliance on AI-generated content.

12. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or abuse of the Service. You may delete your account at any time from your Profile Settings. Upon deletion, your data will be removed within 30 days.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through an in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.
